Toecial respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using this platform.

Filing a Takedown Notice

If you believe that content on Toecial infringes your copyright, please send a written notification to our designated DMCA agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to locate the material on the platform (such as a URL).
  4. Your contact information, including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated DMCA agent. A valid counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which you are located, or if you are outside the United States, any judicial district in which the service provider may be found.

Repeat Infringer Policy

Toecial maintains a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights in appropriate circumstances.

Good Faith Disclaimer

If a counter-notification is received, we may restore the removed content within 10–14 business days unless the copyright owner files an action seeking a court order against the user. We reserve the right to make the final determination about whether content is permissible on the platform.

Please be aware that submitting a false DMCA takedown notice may expose you to liability under 17 U.S.C. § 512(f) for any damages, including costs and attorney's fees, incurred by the alleged infringer, by the platform, or by a licensee.
