All visual depictions displayed on Toecial are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. 75 because they do not depict conduct as specifically listed in 18 U.S.C. § 2256(2)(A) through (D), and/or because they were produced entirely by non-professional or amateur artists, and/or were produced by the depicted individuals themselves.

With respect to any visual depictions displayed on Toecial that are covered by the provisions of 18 U.S.C. § 2257 and 28 C.F.R. 75, all performers depicted were 18 years of age or older at the time of the creation of such depictions. All records required to be maintained pursuant to 18 U.S.C. § 2257 and 28 C.F.R. 75 are kept on file by the designated Custodian of Records and are available for inspection at the address listed below during normal business hours.

Age Verification and Content Policy

Toecial requires all artists (content creators) to complete automated document-based identity verification before any content they upload becomes publicly accessible. This verification is performed via Didit (didit.me) and requires submission of a government-issued photo ID and a real-time liveness check. Content publishing access is locked until verification is confirmed.

As required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75, the following information is extracted from each verified artist's identity check and retained in encrypted form by the Custodian of Records:

• Legal name as it appears on the government-issued ID
• Date of birth as it appears on the government-issued ID
• Document type and issuing country
• Last four digits of the document number
• Date and outcome of the verification check

All artists must also confirm that every person depicted in content they upload is 18 years of age or older at the time of creation, and that the artist possesses or has access to records demonstrating such age.

Any content depicting minors in a sexual manner is strictly prohibited, will be removed immediately, and reported to the appropriate authorities including the National Center for Missing & Exploited Children (NCMEC).
